General Terms and Conditions of Pampolina Europe GmbH & Co.KG


-in the following called Pampolina Europe-


1. Contract Closure

The purchase contract comes into effect with the customer’s order and with written order confirmation by email of Pampolina Europe.


2. Delivery Time

Delivery to Belgium, Netherlands, Denmark and Sweden: Usually deliveries are made within 3 business days, except deliveries against direct debit. In case of delivery against direct debit delivery time will prolong by another 4 business days.


3. Terms of Delivery

Deliveries to Belgium, Netherlands, Denmark and Sweden are free of charge in case of orders exceeding the value of € 50.--.For orders in a lower value shipping charges of € 4.90 will arise. Until such time as full payment has been received, the merchandise remains property of Pampolina Europe GmbH & Co. KG. If an ordered item is not available, we reserve the right to withdraw from the contract. Damages or other claims cannot be asserted.


4. Legal Revocation and Returns Policy


4.1. Right of Revocation

You may revoke your declaration of intent to conclude the contract without specification of reasons within two weeks in text form (e.g. letter, fax, email) or by returning the merchandise in case you received it prior to expiry of the deadline. This deadline begins with the receipt of this instruction in text form, but not before the recipient has received the merchandise (in case of recurrent delivery of merchandise of the same kind not before receipt of the first part delivery) and not before we have fulfilled our duty of information in accordance with § 312c paragraph 2 BGB in conjunction with § 1, 2 and 4 BGB-InfoV and our duties in accordance with § 312e paragraph 1 sentence 1 BGB in conjunction with § 3 BGB Info-V. The deadline is considered met by sending the revocation or the merchandise prior to deadline running out.

4.2. Consequences of Revocation

In the event of an effective revocation, it must be ensured that the services received by both parties are returned along with any benefits gained as a result (e.g. interest). If you are not able to return the service received in full or partly or in the event the merchandise showing wear, compensation may be demanded. This is not the case when the wear on the merchandise can be compared to the type of testing that would, for example, have been possible in a store. By the way, you can avoid the obligation to provide compensation, for wear caused by using the merchandise in a way that is not intended, by treating the items as if they are not your property and not doing anything that may affect their value. Packages are to be returned at our risk. The costs of the return are at your charge, if the delivered merchandise does not correspond to the merchandise ordered and if the price of the returned item does not exceed an amount of € 40.—or if, in the event of a higher price of the item, you have not yet returned the service or made a contractually agreed part payment at the time of revocation. Otherwise the return is free of charge. Items that cannot be sent in package form are collected. Obligations to reimburse payments have to be fulfilled within 30 days. The deadline begins for you with the sending of your declaration of revocation or the merchandise, for us with receipt of same.

4.3. Right of Returns

You may return the merchandise without specification of reasons within two weeks. This deadline begins with the receipt of this instruction in text form, but not before the recipient has received the merchandise (in case of recurrent delivery of merchandise of the same kind not before receipt of the first part delivery) and not before we have fulfilled our duty of information in accordance with § 312c paragraph 2 BGB in conjunction with § 1, 2 and 4 BGB-InfoV and our duties in accordance with § 312e paragraph 1 sentence 1 BGB in conjunction with § 3 BGB Info-V. Only in the event of merchandise that cannot be sent in package form (e.g. large items) you are able to declare the return of the merchandise by requesting collection in text form. The deadline is considered met by sending the merchandise or requesting collection prior to the deadline running out. The return of the merchandise is at our risk and expense. In the event the merchandise showing wear, compensation may be demanded. This is not the case when the wear on the merchandise can be compared to the type of testing that would, for example, have been possible in a store. By the way, you can avoid the obligation to provide compensation, for wear caused by using the merchandise in a way that is not intended, by treating the items as if they are not your property and not doing anything that may affect their value. Obligations to reimburse payments have to be fulfilled within 30 days. 5. Guarantee

Pampolina Europe has to be informed by the customer on any fault of the merchandise delivered by Pampolina Europe without delay, latest within 14 days from receipt of the merchandise. In addition to that, the merchandise is to be returned at the expense of Pampolina Europe. Your legal guarantee claim is ruled by the legal provisions. For all faults that fall under the legal guarantee obligation the legal claims apply according to the customer’s choice (e.g. claims for subsequent fulfillment, elimination of the fault/new delivery and so on). If the customer is a retailer respectively does he buy the merchandise for his commercial use, i.e. if the merchandise is determined for entrepreneurial business dealings, the guarantee obligation of Pampolina Europe is limited to one year. Otherwise the customer’s legal guarantee claim period is 24 months from receipt of the merchandise.


6. Retention of Title

Until such time as full payment has been received, the merchandise remains the property of Pampolina Europe.


7. Privacy Policy

a) All customer data is used by Pampolina Europe solely for the handling of the order. All customer data is stored and handled by Pampolina Europe in compliance with the applicable provisions of the Bundesdatenschutzgesetz (BDSG) and the Teledienst-Datenschutzgesetz (TDDSG).
b) At any time the customer has a right to information, correction, blocking and cancellation of his data, free of charge. The customer will send his request by mail or fax to Pampolina Europe.
c) Pampolina Europe does not forward the personal data of the customer including his home and email address to third parties without his specific permission which can be retracted at any time, except to authorized service providers of Pampolina Europe who require the data for order processing (e.g. the forwarding company entrusted with the delivery of the merchandise or the credit institution entrusted with the handling of payments). In these cases the volume of the data to be forwarded is reduced to a minimum.
d) This website uses cookies. These cookies just provide the use of the shop. No personal data is stored.


8. Governing Law / Place of jurisdiction

German law shall apply. If the customer is a trader, place of jurisdiction shall be Bayreuth.
